Terms of Service

These Terms of Service govern access to and use of the BrokerDrive platform. By using BrokerDrive, the brokerage and its users agree to these terms. This page is for information only and is not legal advice; a signed agreement governs paid use.

Accounts and roles

A brokerage administrator invites users and assigns roles (broker, agent, transaction coordinator, staff). Each user is responsible for keeping their credentials secure. The brokerage is responsible for the actions of users it invites.

Acceptable use

  • Use the platform only for lawful real estate business purposes.
  • Respect MLS display rules and data agreements for any listing data you connect.
  • Do not attempt to access another tenant’s data or circumvent access controls.
  • Do not use the platform to send unlawful communications.

MLS and third-party data

Brokerages connect their own MLS data (for example, via MLS Grid) and are responsible for complying with the applicable MLS rules and data licenses. BrokerDrive does not resell MLS data.

Customer data and ownership

The brokerage retains ownership of the data it puts into the platform. BrokerDrive does not claim ownership of brokerage data and uses it only to provide the service. Data export is available so brokerages can retrieve their data.

Billing

Paid plans are billed per the pricing in effect when you subscribe, based on active seats and any add-ons. Fees are non-refundable except where required by law or expressly stated.

Availability and changes

We work to keep the platform available and may update features over time. We may modify these terms; material changes will be communicated through the platform.

Termination

Either party may terminate per the governing agreement. On termination, the brokerage may export its data within a reasonable period before it is removed.

The platform is provided “as is” to the extent permitted by law. BrokerDrive does not provide legal, tax, or compliance advice; brokerages remain responsible for their own regulatory obligations.
